2013 Season Terms & Conditions:

Angels Baseball Season Seat Terms and Conditions Effective 2013 Season

This Season Ticket Agreement (the “Agreement”) is entered into between the purchaser of the season tickets (“Ticketholder”) and Angels Baseball LP (“Angels”).

In consideration of the promises and mutual covenants herein and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged by all parties, the parties agree as follows:

  1. Each ticket is a grant of a limited, revocable license by Angels to attend the baseball game listed on applicable ticket. The terms of the license are contained in these terms and on each ticket. A purchase of Season Tickets is a grant of a limited, revocable license by the Angels to attend each Pre-Season Exhibition game and Regular Season home game for one baseball season. Regular Season shall mean the regularly scheduled baseball games played by the Los Angeles Angels of Anaheim at the Stadium. Pre-Season Exhibition Game shall mean the games between the Los Angeles Angels of Anaheim and Major League Baseball opponent(s) played at the Stadium prior to the start of the Regular Season. Tickets are not included to any Tie-Breaker Game(s), American League Wild Card Game(s), American League Division Series (“ALDS”), American League Championship Series (“ALCS”) or World Series (collectively, “Playoff Games”) or other events held at Angel Stadium of Anaheim (the “Stadium”) (collectively the “Non-Season Events”). The Angels may, in their sole discretion, offer tickets to sell Ticketholder tickets to Non-Season Events subject to any rules set forth by Major League Baseball or the applicable Non-Season Event promoter.
  2. Ticket shall not be used for advertising, promotion (including, contests and sweepstakes), or other trade or commercial purposes without the express written consent of the Angels.
  3. This Agreement and any licenses granted by the purchase of season tickets may not be assigned or transferred in any manner by Ticketholder to any other party. Season tickets and the license to attend any of the games may not be sold, assigned, hypothecated, or in any manner transferred without the express written consent of Angels. In the event of any purported transfer, offer of transfer, or attempted transfer, Angels have the right but not the obligation to terminate this Agreement by providing written notice to Ticketholder and tendering the pro rata portion of the amount paid by Ticketholder a reasonable time after providing such notice.
  4. Parties agree it is a material breach of this Agreement for Ticketholder to complete or attempt the sale, trade, forward, or any other transfer to a third party ticket broker, agency, or individual who purchases, sells, and/or otherwise transfers event tickets without the express written consent of Angels.
  5. In the event of a material breach by Ticketholder, Angels shall have the right but not obligation to terminate the Ticketholder account for any purported violation of this provision. In the event that Angels terminate the account under this paragraph, Ticketholder agrees to pay the Angels liquidated damages in the amount equal to the balance on the Ticketholders account at the time of termination.
  6. The Angels may provide a ticket resale and/or transfer system, or another Advanced Service (the “System”). Any and all use of the System is subject to the terms and conditions associated with accessing said System. The Angels reserve the right to suspend, modify, and/or cancel the system or issue alternative Advanced Services at any time in their sole discretion. The Angels reserve the right to disengage Ticketholder’s access to electronically post for sale and forward tickets or revoke Ticketholder’s season tickets if the System Terms & Conditions are violated. However, the Angels may, in their sole discretion, prohibit certain tickets or certain amounts of tickets to be posted or limit the number of aggregate games during the Season that may be posted.
  7. The Angels do not consent to the resale of parking passes and seats in Diamond Club Table locations by any means.
  8. This Agreement is for a one-season term and will expire at the conclusion of the season in which tickets are purchased. No rights or obligations, including without limitation renewal, are created or conferred on either party beyond the term of this Agreement. Season tickets are issued and may be renewed in the sole discretion of the Angels.
  9. Angels may terminate this agreement at any time upon providing written notification to Ticketholder. Within a reasonable time after termination, Angels shall return the pro rata portion of the license fee for the remaining home games in the term to the Ticketholder.
  10. Ticketholder may only terminate this agreement by providing written notice to Angels and relinquishing all season tickets to the ticket office no less than thirty (30) days prior to the first exhibition home game of the 2013 season. Time is of the essence for any such termination.
  11. The Angels shall reserve the right to set a limit on how many season tickets a Ticketholder may purchase for a one-season term.
  12. The Ticketholder of record is listed on the account as the primary contact. Only the primary contact listed on the account is allowed to make any changes to the account. This person is also obligated to promptly notify the Angels in writing of any changes in address, phone number, or account status. Accounts cannot be transferred from one Ticketholder to another individual or entity.
  13. The Angels are not responsible for lost tickets, stolen tickets, or tickets left at another location. Tickets may be replaced at the sole discretion of the Angels for an additional cost, equal to the face value for each ticket. Stolen season tickets will only be replaced upon written request of Ticketholder accompanied with a police report. In the event the Angels replace a ticket, the replacement ticket will be honored over the original ticket.
  14. Ticketholder agrees that the purchase of season tickets may, in the sole discretion of the Angels and subject to availability, include the opportunity to purchase preferred parking on terms and in locations determined by the Angels.
  15. Ticketholder agrees on behalf of themselves and anyone using a season ticket on the account to voluntarily assume all risks and dangers incident to attending a game of baseball including all personal or property injury or death caused by or related to thrown, batted, dropped, and/or launched balls, bats, promotional items, or other projectiles, whether occurring before, during, or after the game. Ticketholder agrees on behalf of themselves and anyone using a season ticket on the account that the Angels, Major League Baseball, American League, the National League of Professional Baseball Clubs, participating Clubs, and their agents, employees, owners, partners, trustees, and related entities are not responsible for any such injuries.
  16. Ticketholder agrees on behalf of themselves and anyone using a Season Ticket on the account that they will adhere to the food, beverage, and smoking policies at all times.
  17. The license to attend the game does not include the license to attach, hang, and/or display signs, advertising, banners, or other notices in the Stadium.
  18. By attending the game, the ticket user agrees to be bound by all terms listed on the back of the ticket, incorporated herein by reference.
  19. Ticketholder consents on behalf of themselves and anyone using a season ticket on the account that the Angels or their designated agents may search the person, bags, clothing, and other articles prior to entry into the Stadium. Angels will provide full wheelchair accessible seating in spaces or locations designated as such and no permanent fixed chair will be provided for these locations. Further, up to three additional companion seats contiguous to the wheelchair location or companion location may be purchased. Additional companion seats may be movable or fixed chairs. It is the responsibility of the Ticketholder to communicate this policy to the ticket user.
