The object of the 2013 MLB Fan Cave: World Baseball Classic edition Contest (the "Contest") is to submit original writing samples, an original video, your photo and resume/curriculum vitae (i.e., a document setting forth your background and skills) as detailed below (collectively, the "Submission") to be selected as a Contest winner to live the dream baseball experience during the 2013 World Baseball Classic tournament (the "Tournament"). World Baseball Classic, Inc. ("Sponsor") and its consultants (the "Judges") will select the winning Submissions in accordance with criteria set forth in these Official Rules.
The Contest is open only to citizens or lawful permanent residents of the fifty (50) United States and the District of Columbia, Puerto Rico, Canada (excluding residents of the Province of Quebec), who are citizens or lawful permanent residents of the United States, Canada, Mexico, Dominican Republic, Venezuela, South Korea, Japan, Spain, China, Australia, the Netherlands, Italy, Brazil or Chinese Taipei, who are twenty-one (21) years of age or older at the time of entry with a valid e-mail address and Internet access as of December 10, 2012. Any Participant who identifies his/her Country (as defined below) of ancestry as Cuba must, at such time as requested by Sponsor, furnish proof in the form of at least two (2) documents (such as a passport, voter registration card, permanent resident alien card or national identity card) that he/she is eligible to receive a prize under the terms of federal law (31 C.F.R. ยง 515.505). Employees, officers and directors (including immediate family members (any spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of Sponsor, the other WBC Entities (as defined below) and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the Contest are not eligible to participate or win a Prize (as defined below). The "WBC Entities" shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. ("MLBAM" or "MLB.com"), Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc., the Major League Baseball Clubs, The MLB Network, LLC, Tickets.com, Inc., SportsOnEarth, LLC, Major League Baseball Players Association, The thirty (30) Major League Baseball Clubs, the federations and teams participating in the Tournament, all players, coaches and managers participating and/or eligible to participate in the Tournament and each of their respective subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the above entities, and the directors, officers, employees, members, and agents of the above entities. The Contest is subject to all applicable international, national, federal, state, provincial and local laws, rules and regulations. Void in the Province of Quebec and where prohibited or restricted by law, rule or regulation.
The Contest entry period begins on December 10, 2012 at 9:00:01 AM United States Eastern Time ("ET") and ends on January 11, 2013 at 11:59 PM ET (the "Entry Period"). To enter, Participants (defined below) must log on to www.MLBFanCave.com/WBC during the Entry Period and click on the Contest banners, buttons and/or links to access the online entry form for the contest. To enter, Participants must read and consent to these Official Rules during the Contest entry process. Participants must also provide their complete name, date of birth, address, city, state/province/territory, Country, ZIP/postal code, telephone number, e-mail address, and Submission pursuant to (1) the Submission Requirements (set forth below), and (2) the Content Restrictions (as set forth in the Content Restrictions section below). Participants must identify their country of ancestry or residency, which will be the team in the Tournament they would represent (their "Country") and be fluent in both English and the language of their Country.
Online entry only. No other method of entry will be accepted. Participants are solely responsible for Internet connectivity, software and/or hardware that may be required in order to create and/or submit any Submission.
Each entry must include a valid e-mail address for the applicable Participant. All information submitted by Participants is subject to, and will be treated in a manner consistent with, MLB.com's Terms of Use accessible at: http://mlb.mlb.com/mlb/official_info/about_mlb_com/terms_of_use.jsp and Privacy Policy accessible at: www.mlb.com/privacy. The Judges will judge all eligible Submissions based on the following equally-weighted criteria ("Judging Criteria"):
On or about February 4, 2013, the Judges will consider the overall combined scores based on the Judging Criteria to select the top sixteen (16) Submissions received, including using good faith efforts to select at least one (1) Submission from a resident/citizen of each country participating in the Tournament (the "Winning Submissions"). In the event that an insufficient number of eligible Submissions that meet the minimum judging criteria are received from any particular country, Sponsor reserves the right to select a replacement Submission from any other country from which eligible Submissions were received. For purposes of clarification, Sponsor is not obligated to select at least one (1) Winning Submission from each country in the event there are an insufficient number of eligible Submissions that meet the minimum judging criteria from any country, but Sponsor may instead select the Winning Submissions from any country in that instance.
On or about February 25, 2013, the Judges will announce sixteen (16) Winning Submissions by such method and/or media as Sponsor determines, in its sole discretion.
Sixteen (16) eligible Participants who submitted the Winning Submissions, as determined by the Judges pursuant to the Judging section above, will be the potential Contest winners (each, a "Winner" and collectively, the "Winners"), provided, however, that (i)each such Participant must fully comply with and satisfy all requirements set forth in these Official Rules, including those detailed in the Notification section; and (ii) each such Participant must sign an agreement with Sponsor which will set forth the rules, requirements, terms and conditions, as determined in Sponsor's sole and absolute discretion, for participation in the "2013 MLB Fan Cave: World Baseball Classic edition Experience" (as defined below). In the event any such Participant does not, or is not able to, sign the Participation Agreement, he/she will be disqualified. Each Winner will receive the opportunity to live the dream baseball experience for some portion or all of the 2013 Tournament: he/she will travel to New York City, New York to watch the 2013 Tournament games at the MLB Fan Cave("2013 MLB Fan Cave: World Baseball Classic edition Experience").
While participating in the 2013 MLB Fan Cave: World Baseball Classic edition Experience, each Winner will: 1) watch every single baseball game played in the 2013 Tournament until, if applicable, such Winner's Country's team is eliminated from the Tournament, in which event, such Winner will return home to his/her country or place of residence; 2) keep and submit a daily journal entry regarding his/her experience, which may be used by Sponsor and its designees in the manner set forth in the Consent, License and Release section below; and 3) participate in a minimum of three (3) media interviews on behalf of Sponsor and the Tournament for publicity purposes (the "Prize"). Sponsor will provide air transportation to New York City (or ground transportation, if a Winner's place of residence is deemed to be within driving distance of New York City, as determined in Sponsor's sole discretion) with initial departure from the major gateway airport nearest the Winner's place of residence and, if the Winner's Country's team does not advance to the semi-final games in the Tournament, air transportation from New York City to the major gateway airport nearest the Winner's place of residence (or ground transportation to the Winner's place of residence, if applicable in Sponsor's sole discretion, per above), standard hotel accommodations during the period that he/she is participating in the 2013 MLB Fan Cave: World Baseball Classic edition Experience, ground transportation between the airport (if applicable) and the Winner's place of residence/hotel and a stipend of $107.00 per day for living expenses for each Winner during the period that he/she is participating in the 2013 MLB Fan Cave: World Baseball Classic edition Experience, as determined by Sponsor in its sole discretion (such stipend to be provided in the form of a pre-paid debit card or voucher for any Winner who is a resident of Brazil).
The four (4) Winners whose countries' teams advance to the semi-final games in the Tournament will travel from New York City to San Francisco, California to watch the semi-final and final games live. Sponsor will provide air transportation from New York City to San Francisco, California, standard hotel accommodations during the period that he/she is attending the semi-final and final games of the Tournament, ground transportation between the airport (if applicable) and the Winner's place of residence/hotel and a stipend of $107.00 per day for living expenses for each Winner during the period that he/she is attending the semi-final and final games of the Tournament, as determined by Sponsor in its sole discretion (such stipend to be provided in the form of a pre-paid debit card or voucher for any Winner who is a resident of Brazil). At the conclusion of the Tournament, Sponsor will also provide air transportation from San Francisco, CA to the major gateway airport nearest the Winner's place of residence (or ground transportation if a Winner's place of residence is deemed to be within driving distance of San Francisco, CA, as determined in Sponsor's sole discretion).
Exact Prize details shall be determined in the sole and absolute discretion of the Sponsor. Each Prize is non-transferable and non-assignable, with no cash redemptions except at Sponsor's sole and absolute discretion.
Each Winner is fully responsible for any and all applicable taxes of his/her country/state/province/territory/locality of citizenship and/or residence, whether international or U.S. (including income and withholding taxes), except for any Winner who is a resident of Brazil. All meals, gratuities, incidentals, travel upgrades, fees, service charges, surcharges, insurance costs or other costs and expenses associated with Prize acceptance and use not specified herein as being provided by Sponsor are the sole responsibility of each Winner. Limit one (1) Prize per person, family or household. Approximate retail value ("ARV") of each Prize: $2,000.00 - $13,000.00. Total ARV of all Prizes combined: $32,000.00 - $208,000.00. Actual retail value will depend on each Winner's place of residence, air flight fluctuations and how long such Winner's Country's team remains in the Tournament. Winners will not receive the difference between ARV and actual retail value. Initial travel to New York City must take place between 2/28/13 and 3/1/13 or Prize will be forfeited and may be awarded to an alternate Winner. If any Winner is unable to travel during the dates specified by Sponsor for all or any portion of the 2013 MLB Fan Cave: World Baseball Classic edition Experience, such Winner will forfeit the 2013 MLB Fan Cave: World Baseball Classic edition Experience or the applicable portion thereof. Sponsor is not liable for delays, cancellation or unforeseen events related to flights. Each Winner will be solely responsible for obtaining valid identification, passport, visa and/or other travel documentation relating to acceptance and use of the Prize and ensuring no impediment to him/her entering the U.S. Sponsor will not replace any lost, mutilated or stolen tickets, travel vouchers or certificates. Sponsor at its sole discretion may substitute a prize (or component of a prize) of equal or greater value due to Prize unavailability for any reason.
Sponsor will be responsible for resolving any disputes and rules violations that arise in connection with the Contest. All decisions by Sponsor and/or the Judges regarding the Contest shall be final and binding in all respects.
In exchange for the opportunity to participate in this Contest, and the possibility of the use of Participant's Submission and/or the Participant's appearing in an audio, visual and/or multimedia production the receipt of which opportunities shall be sufficient consideration for this Consent, License and Release, each Participant does hereby:
Nothing herein will obligate the WBC Entities to make any use of any of the rights set forth herein. In the event that any individual(s) appears with the Participant in the Submission but does not submit a separate Consent, License and Release, the Participant hereby represents and warrants (i) that such individuals(s) has authorized Participant to agree to this Consent, License and Release on his/her behalf (or, with respect to any individual under the age of majority in his/her jurisdiction of residence, that Participant is the parent and/or legal guardian of such individual(s) with legal authority to act on behalf of such individual), and (ii) that Participant agrees to this Consent, License and Release on behalf of such individual(s). Individual(s) appearing with the Participant in the Submission shall have no rights to any prizes awarded.
Participants must not include any of the following content (the "Content Restrictions") in any Submission: (i) pornography, adult-oriented content or any other sexually-explicit material; (ii) materials relating to lotteries or gambling; (iii) explicit language or content, images of violence, or promotion of illegal activities; (iv) content in violation of intellectual property rights or laws; (v) libelous, defamatory, disparaging, tortuous or slanderous materials; (vi) content that denigrates, disparages or reflects negatively on the WBC Entities, their owners, players and employees, or the game of baseball; (vii) tobacco, alcohol or drugs; (viii) dangerous stunts or any dangerous behavior; (ix) real weapons of any kind including, but not limited to, guns, knives or projectiles; (x) material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any other basis protected by national, federal, state, provincial or local law, ordinance, or regulation; (xi) individuals under legal age of majority without providing a signed release from parent or legal guardian; (xii) audio and/or visual content owned by any third party (e.g., recorded music; pre-produced video, etc.); and (xiii) material that is unlawful, or otherwise in violation of or contrary to the laws or regulations in any jurisdiction where the Submission is created. Any Submission that does not comply with the foregoing, in the sole discretion of Sponsor, will be disqualified and eliminated from consideration.
Each potential Winner will be notified by e-mail and/or telephone by Sponsor on or about February 11, 2013 and may (in Sponsor's discretion) be confirmed by postal mail or other appropriate and reliable means, return receipt requested (the "Prize Notification"). In the event that any potential Winner does not respond to such Prize Notification within three (3) calendar days of the date of issuance, a disqualification and prize forfeiture will result and, at Sponsor's sole discretion and time permitting, an alternate potential Winner shall be chosen from among all remaining eligible Submissions received from that disqualified potential Winner's Country (or if there are no eligible Submissions that meet the minimum judging criteria from such Country, Sponsor may, in its sole discretion, select the alternate potential Winner from among all remaining eligible Submissions). Each potential Winner will be required to submit his/her valid social security number and/or other applicable identification to Sponsor, authorize a full background check, and execute, have notarized and return (for any Puerto Rican potential Winner, at his/her own expense) an Affidavit/Declaration of Eligibility and Release of Liability, and, unless prohibited by law, Publicity, within five (5) days of the date of receipt of Prize Notification. A disqualification and prize forfeiture will result and, at Sponsor's sole discretion and time permitting, an alternate potential Winner will be selected from among all remaining eligible Submissions received from that disqualified potential Winner's Country if all required documents are not properly executed and returned within the specified period of time and/or if the potential Winner does not pass a background check to the satisfaction of Sponsor, in its sole discretion. Refusal or return of such documents as non-deliverable, rejection of any Prize or any potential winner's noncompliance with these Official Rules will also result in disqualification, prize forfeiture and, at Sponsor's sole discretion and time permitting, may cause an alternate potential Winner to be chosen from among all remaining eligible Submissions received from that disqualified potential Winner's Country. Upon any prize forfeiture, no compensation will be awarded.
By participating in the Contest, each Participant (a) accepts and agrees to be bound by these Official Rules, including all eligibility requirements, the MLB.com Privacy Policy and MLB.com Website Terms of Use; and (b) gives his/her express permission to be contacted by Sponsor and/or its representatives for Contest administration purposes. In the event of any conflict between the English version of these Official Rules and any translation, the English version shall prevail.
All applicable international, national, federal, state, provincial and local laws and regulations apply. This Contest and these Official Rules will be governed by the laws of the State of New York, United States of America. Except where prohibited by law, any court of competent jurisdiction sitting within the New York County, State of New York, United States will be the exclusive jurisdiction and venue for any dispute arising out of or relating to this Contest or these Official Rules. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
To the extent permitted by law, the WBC Entities and each of their respective parent companies, trustees, subsidiaries, franchisees, assignees, affiliates, licensees, agents, independent contractors, telecasters, sponsors, licensees and advertising and promotional agencies, and each of their respective general and limited partners, members, shareholders, officers, directors, agents, employees, representatives and contractors (collectively, the "Released Parties") shall not be responsible for lost, late, stolen, garbled, delayed, undelivered, or misdirected entries, for incorrect, inaccurate or incomplete entry information whether caused by a Participant, equipment, or technical malfunction or for any human error, technical error or malfunctions.
To the extent permitted by law, the Released Parties are not responsible for any technical, computer, network, typographical, printing, human or other errors relating to or in connection with this Contest, including, without limitation, errors or problems which may occur in connection with the offer or administration of this Contest, the processing of entries, the tabulation of scores, the cancellation of games or any errors appearing in any Contest related-materials including, but not limited to, errors in advertising, the Official Rules, the selection and announcement of Winners or the distribution of the Prizes. Sponsor reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest.
To the extent permitted by law, the Released Parties make no warranties, express or implied, relative to the use or enjoyment of any Prize or portions thereof, including without limitation, its quality, merchantability or fitness for a particular purpose. By entering the Contest, each Participant agrees to indemnify and hold harmless and fully release the Released Parties from any and all liability for any injuries, losses, death, or damages of any kind caused by participation in the Contest, Contest-related activity, Participant's Submission, or resulting from the acceptance, possession, quality, use or misuse of any Prize, or any portion of any Prize, including any travel or activity related thereto.
Sponsor reserves the right to conduct a full background check, including but not limited to, criminal history, on any potential Winner (which, in the case of any Canadian potential Winner, will be conducted solely to ensure he/she can enter the U.S.). To the extent required by law, each such potential Winner shall authorize such background check. Sponsor reserves the right, in its sole and absolute discretion, to disqualify any potential Winner based on the results of such background check, including without limitation if such Winner has been convicted of a felony or sexual offense.
The Contest is a skill contest designed to increase consumer awareness of and interest in Major League Baseball and MLB.com, the Official Site of Major League Baseball. This Contest may not be used for, or in connection with, any form of gambling. The Contest is a game of skill, and chance plays no part in determining winners.
If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, cancellation of games, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion and to the extent permitted by law, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest and, if terminated, to determine the Winners, if any, from among all eligible, non-suspect Submissions submitted up to the point of termination.
To the extent permitted by law, the Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Parties are not responsible for any problems or technical malfunction of any telephone network, cable, satellite, Internet Service Provider (ISP) or lines, computer systems, servers, or providers, computer equipment, software, failure of any e-mail, tweet or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to Participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest.
CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CONTEST OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH PARTICIPANT, AND SPONSOR, MLBAM AND/OR THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY SUCH PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
In the event of dispute as to the identity or eligibility of any potential Winner based on an e-mail address, the winning Submission will be declared made by the "Authorized Account Holder" of the e-mail address submitted at the time of entry provided he/she is eligible according to these Official Rules. The "Authorized Account Holder" is defined as the natural person to whom the applicable Internet service provider or other organization (such as a business or educational institution) has assigned the e-mail address for the domain associated with the submitted e-mail address.
In the event that the Contest is challenged by any legal or regulatory authority, Sponsor reserves the right to discontinue or modify the Contest, or to disqualify Participants residing in the affected geographic areas. In such event, the Released Parties shall have no liability to any Participants who are disqualified due to such an action.
For Winner information (available from February 11, 2013 until April 11, 2013), mail a request and a self-addressed, stamped envelope to: 2013 MLB Fan Cave: World Baseball Classic edition Contest, World Baseball Classic, 31st floor, 245 Park Avenue, New York, NY 10167. Residents outside the U.S. may omit return postage. Winner's List requests must be received by April 11, 2013.
