2010 Season Predictions Official Rules

Introduction

The object of 2010 MLB.com Season Predictions (the "Contest") is to apply your skill and knowledge of Major League Baseball to correctly select the eight (8) Major League Baseball teams you think will participate in the 2010 MLB postseason, the team you think will win the 2010 American League Championship Series, the team you think will win the 2010 National League Championship Series, the team you think will win the 2010 MLB World Series Championship, the Major League Baseball player you think will win the 2010 Baseball Writers' Association of America ("BBWAA") American League Most Valuable Player Award (the "AL MVP Award"), the Major League Baseball player you think will win the 2010 BBWAA National League Most Valuable Player Award winner (the "NL MVP Award"), the Major League Baseball player you think will win the 2010 BBWAA American League Cy Young Award (the "AL Cy Young Award")and the Major League Baseball player you think will win the 2010 BBWAA National League Cy Young Award (the "NL Cy Young Award").

Eligibility

The Contest is open only to legal residents of the fifty (50) United States, Washington D.C. and Canada (excluding residents of the Province of Quebec) who are of legal age of majority in their jurisdictions of residence (and at least eighteen (18) years of age in the U.S.) as of the date of entry with a valid e-mail address and Internet access as of February 28, 2010. Void in the Province of Quebec and where prohibited by law, rule or regulation. Employees or consultants of the MLB Entities (defined below) or any of their respective parents, affiliates, subsidiaries or advertising and promotion agencies, and their immediate family members (parent, sibling, child or spouse and their respective spouses, regardless of where they reside) and any person residing in their same households, whether or not related, are not eligible to participate or win a prize. The "MLB Entities" shall mean MLB Advanced Media, L.P. ("MLBAM"), the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc. , the Major League Baseball Clubs, Tickets.com, Inc., SportsOnEarth, LLC and each of their respective subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the shareholders, parents, Office of the Commissioner of Baseball, and the directors, officers, representatives, employees, agents, successors and assigns of the above entities.

How to Enter

You may enter the Contest from 12:00 a.m. Eastern Time ("ET") on March 1, 2010 through 5:00 p.m. ET on March 31, 2010 (the "Entry Period"). To enter, during the Entry Period visit www.mlb.com/predictions and click on the banners, buttons and/or links to access the online entry form for the Contest (the "Entry Form"). Participants must fully complete and submit all non-optional data requested on the Entry Form to be eligible. Incomplete, inaccurate and/or misspelled entries and/or selections are void. All entries must include a valid e-mail address for the participant. No other method of entry will be accepted. Limit one (1) entry per person. In case of multiple entries received from any person, only the first entry received from such person will be considered. Additional entries beyond the specified limit will be void. Entry Forms must be submitted by 5:00 p.m. ET on March 31, 2010 to be eligible. Please note that all information submitted by participants is subject to, and will be treated in a manner consistent with, the MLB.com Terms of Use accessible at http://mlb.mlb.com/mlb/official_info/about_mlb_com/terms_of_use.jsp and Privacy Policy accessible at: www.mlb.com/privacy. Entries generated by script, macro or other automated means or utilizing any other method or means which in MLBAM's sole discretion impacts the integrity of the Contest or is in violation of these Official Rules will be void. Participants to the Contest may be given the option to receive (a) commercial e-mails from MLB.com and/or Gillette, and/or (b) mobile text messages and updates from MLB.com; however, eligibility to participate in the Contest is not dependent upon participant's consent to receive such e-mails and/or mobile text messages and updates and consenting to receive such e-mails and/or mobile text messages and updates will not impact your chances of winning. Standard messaging rates apply to mobile text messages and updates. Check with your mobile service provider for more information.

Contest Period

The Contest begins at 5:01 p.m. ET on March 31, 2010 and ends upon the BBWAA's final selections of the AL MVP Award, NL MVP Award, AL Cy Young Award and the NL Cy Young Award, as applicable (the "Contest Period").

Filling Out Your Entry Form

Use the drop-down menus on the Entry Form to select the Major League Baseball teams you think will win each of the following:

  • 2010 American League East champions
  • 2010 American League Central champions
  • 2010 American League West champions
  • 2010 American League Wild Card
  • 2010 National League East champions
  • 2010 National League Central champions
  • 2010 National League West champions
  • 2010 National League Wild Card
  • 2010 National League champions
  • 2010 National League champions
  • 2010 World Series champions

Each participant must also enter into the applicable fields of the Entry Form the full names (i.e. first name and last name) of the Major League Baseball players he/she think will win the following awards as voted on and determined by the BBWAA:

  • 2010 American League Most Valuable Player Award winner
  • 2010 National League Most Valuable Player Award winner
  • 2010 American League Cy Young Award winner
  • 2010 National League Cy Young Award winner

IMPORTANT NOTE: You must include the full name (i.e. first name and last name) of each Major League Baseball player you select. Incomplete, inaccurate and/or misspelled entries and/or selections are void.

In addition, you must also select an answer to the following tiebreaker question: total number of combined home runs in each league (AL and NL) hit during the 2010 regular season.

NOTE: For the avoidance of doubt, only awards, statistics and other results officially determined by the BBWAA, Major League Baseball and/or MLBAM, as applicable, will be counted as valid results in the Contest.

Selection Deadline

The deadline for submitting an Entry Form is 5:00 p.m. ET on March 31, 2010. MLBAM's computer shall be the official clock of the Contest. If you fail to submit an Entry Form before this deadline, you will not be eligible to participate in the Contest. Once you have submitted your Entry Form, you will not be able to change any selection.

Scoring

Scoring in the Contest is as follows: you will receive one (1) point for each correct selection, as determined by MLBAM in its sole and absolute discretion.

For example: If a participant chooses Boston Red Sox to win the American League East division, and the Boston Red Sox win the American League East division, participant will receive one point for that selection.

Since there are fifteen (15) total results from which participants can select in the Contest, any participant can receive a maximum of fifteen (15) points.

Grand Prize

The eligible participant who has accumulated the highest number of points greater than or equal to twelve (12) points during the Contest Period (the "Winner") will win two (2) tickets for Winner and his/her guest to the 2011 MLB All-Star Game to be played at Chase Field in Phoenix, Arizona (the "Grand Prize") (Estimated retail value of Grand Prize: US$300).

NOTE: GRAND PRIZE WILL NOT BE AWARDED IF NO ELIGIBLE PARTICIPANT ACCUMULATES AT LEAST TWELVE (12) POINTS.

TRANSPORTATION TO/FROM THE GAME AND LODGING NOT INCLUDED. Seat locations at the 2011 MLB All-Star Game shall be selected by MLBAM at its sole and absolute discretion. The Winner is fully responsible for any and all applicable federal, state, provincial and local taxes (including income and withholding taxes). All costs and expenses not specified herein as being provided related to the acceptance and use of any prize are the sole responsibility of the Winner. The Grand Prize is non-transferable and non-assignable, with no cash redemptions except in MLBAM's sole and absolute discretion. MLBAM reserves the right to substitute a prize of comparable or greater value at its sole and absolute discretion. All prize details are at the sole discretion of the MLBAM.

Major League Baseball game, event and exhibition dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and may be subject to change. Winner's companions must be of legal age of majority in his/her jurisdiction of residence, unless traveling with a parent or legal guardian. Grand Prize does not include tickets to All-Star Sunday, Home Run Derby, All-Star Workout Day, MLB All-Star FanFest or any other event or exhibition during the 2011 MLB All-Star Week apart from the 2011 MLB All-Star Game. The terms and conditions of the tickets awarded as prizes will govern in the event the 2011 MLB All-Star Game is not played due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. Winner and his/her guest(s) agree to comply with all applicable stadium regulations in connection with the Grand Prize. The applicable MLB Entities reserve the right to remove or to deny entry to Winner and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition. The MLB Entities and each of their respective parent companies, trustees, subsidiaries, franchisees, affiliates, licensees, agents, independent contractors and advertising and promotional agencies, and each of their respective officers, directors, agents and employees (collectively, the "Released Parties") will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster that may cause the cancellation or postponement of any Major League Baseball game, event or exhibition.

Tiebreakers

In the event of a tie for the Grand Prize, tiebreakers will be used among the remaining tied participants in the following order until only one (1) potential Winner remains:

  1. Correct selection of the total number of home runs hit by all Major League Baseball players during the 2010 Major League Baseball regular season; and
  2. MLBAM will administer a timed baseball trivia quiz, testing the tied participants' knowledge of Major League Baseball, until the tie is broken.

The participant whose submission is closest to the correct answer will be deemed the Winner of the applicable tiebreaker.

Notification

The potential Winner will be notified by e-mail and/or telephone (in MLBAM's discretion) and may (in MLBAM's discretion) be confirmed by postal mail, return receipt (the "Prize Notification"). In the event that the potential Winner does not respond to any such Prize Notification within five (5) days of date of issuance, a disqualification will result and prize will be forfeited and, at MLBAM's sole discretion, awarded to the runner-up (if applicable). The Winner may be required to submit his/her valid social security number and/or other identification to MLBAM and shall be required to execute, have notarized and return an Affidavit of Eligibility (or, if a resident of Canada, a declaration) and Release of Liability and, where legal, Publicity within five (5) days of date of issuance. Winner's companion (if a minor, his/her respective parent or legal guardian) may also be required to sign & return a Liability Release & (where legal) Publicity Release prior to the issuance of game tickets. Failure to submit any identification required by MLBAM or to return the required documents within the specified time period, noncompliance with these Official Rules or the return of any prize or Prize Notification as undeliverable may result in disqualification and prize will be forfeited and, at MLBAM's sole discretion, awarded to the runner-up (if applicable).

Game Administration

By registering and/or participating in the Contest, each participant agrees that MLBAM will solely resolve any disputes and rules violations that arise in connection with the Contest. All decisions by MLBAM regarding the Contest shall be final and binding in all respects. Any incidence of collusion or cheating, as determined by MLBAM in its sole discretion, will be subject to disqualification from the Contest without limitation to any other rights or remedies available to MLBAM. General Conditions

By registering and/or participating, each participant accepts and agrees to be bound by these Official Rules, the MLB.com Privacy Policy and Terms of Use, and by the decision(s) of MLBAM which shall be final and binding in all respects.

Each participant agrees to allow MLBAM and its designees to use their names and likenesses in any and all mediums now or hereafter known for advertising and publicity purposes throughout the world in perpetuity, without any compensation, notification or permission, unless prohibited by law.

All applicable federal, state, provincial and local laws and regulations apply. This Contest and these Official Rules will be governed by the laws of the State of New York. Any court of competent jurisdiction sitting within the State of New York, New York County will be the exclusive jurisdiction and venue for any dispute arising out of or relating to this Contest or these Official Rules. MLBAM's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Released Parties are not responsible for lost, late, stolen, garbled, delayed, undelivered or misdirected entries, selections or registrations, for incorrect, misspelled, inaccurate or incomplete entry information whether caused by a participant, equipment, or technical malfunction or for any human error, technical error or malfunctions. No screen shots of any kind will be allowed as proof of submission of any Contest entry.

Released Parties are not responsible for any technical, computer, network, typographical, printing, human or other errors relating to or in connection with this Contest, including, without limitation, errors or problems which may occur in connection with the offer or administration of this Contest, the processing of entries, selections or registrations, the tabulation of scores, the cancellation of games or any errors appearing in any Contest related-materials, including, but not limited to, errors in advertising, the Official Rules, the selection and announcement of the Winner or the distribution of the prizes. MLBAM reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest.

The Released Parties make no warranties, express or implied, relative to the use or enjoyment of any prize or portions thereof, including without limitations, its quality, merchantability or fitness for a particular purpose. By entering the Contest, each participant agrees to indemnify, hold harmless and fully release the Released Parties from any and all claims, demands, losses, promises, causes of action and liabilities for any injuries, losses, death, or damages of any kind caused, directly or indirectly, in whole or in part, by participation in the Contest, or resulting from the acceptance, possession, quality, use or misuse of any prize, or any portion of any prize, including any travel or any activity related to the receipt or use of any prize.

MLB.com Season Predictions is a skill contest designed to increase consumer awareness of and interest in Major League Baseball and MLB.com, the Official Site of Major League Baseball. This Contest may not be used for, or in connection with, any form of gambling.

Rules/Winner Information

For Winner information (available after December 1, 2010) or an additional copy of the Official Rules, send a self-addressed, stamped envelope to: 2010 Season Predictions c/o Melissa Wester, MLB Advanced Media, L.P., 75 Ninth Avenue, New York, NY 10011. Specify "Rules" or "Winner List." Requests must be received by September 30, 2010. Residents of VT and Canada may omit return postage on rules requests.

Internet

If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, cancellation of games or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, MLBAM reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest and, if terminated, to determine the Winner, if any, from among all eligible, non-suspect scores achieved up to the point of termination.

The Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Parties are not responsible for any problems or technical malfunction of any telephone network, cable, satellite, Internet Service Provider (ISP) or lines, computer systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest.

CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MLBAM WILL DISQUALIFY ANY SUCH PARTICIPANT AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.

All entries must include a valid e-mail address for the participant. In the event of a dispute as to the identity of a participant, an entry will be declared made by the Authorized Account Holder of the e-mail address submitted at the time of entry provided he/she is eligible according to these Official Rules. "Authorized Account Holder" is defined as the natural person to whom the applicable Internet service provider or other organization (such as a business or educational institution.) has assigned the e-mail address for the domain associated with the submitted e-mail address.

In the event that the Contest is challenged by any legal or regulatory authority, MLBAM reserves the right to discontinue or modify the Contest, or to disqualify participants residing in the affected geographic areas. In such event, the Released Parties shall have no liability to any participants who are disqualified due to such an action.
